As often as we hear it, though, it’s surprising how few people follow that simple piece of advice. You have the absolute right to remain silent when the police are questioning you — or even if they’re not. Remember, what may seem like an innocent statement can often come back to haunt you as you fight criminal charges.
What To Expect As A Criminal Defendant
Attorney Joseph L. Kirkland will begin working for you immediately by helping friends or family with the bail process if you’ve been detained. We then work with a team of expert investigators who interview witnesses and review physical evidence to determine whether a crime even occurred.
We will review police procedures to make sure they did not violate your constitutional rights. We then present the state attorney’s office with the evidence we have collected and our legal analysis of the charges, and argue to have the charges dismissed or to have lesser charges instated instead. Those negotiations can especially be successful for minor crimes and when our client has no prior criminal record. If the negotiation is unsuccessful, we are available to arrange a plea bargain or prepare your case for trial.
